ISWest.com and ISPWest.com: Do They Look Similar?
Always looking to keep my eye out for interesting news in the domain industry, I came across a story earlier today regarding a court case between Internet Specialties West v. Milon Digiorgio Enterprises, Inc. Internet Specialties west, the plaintiff, owned the domain name ISWest.com, and sued Milon Digiorgio Enterprises for trademark infringement with their domain name ISPWest.com. Do those look confusingly similar to you?
Well, apparently they looked confusingly similar to the jury, because Internet Specialties won the case. Personally, I think no one in there right mind would get them confused. And if anything, ISPWest is helping them because when people forget the P in ISPWest, it becomes ISWest, and gives ISWest.com more traffic. So I was very surprised to read the outcome of the case.
The jury said that because they were confusingly similar, and offered similar services, that was the reason for their verdict.
For the past few days I have been talking about different laws, and acts in domaining, so I felt an actual case would be beneficial for viewers to see. Please comment your thoughts on the similarities of the names.
Interesting article. I’d like to know the details of the case. But it’s a shame to see what may have been an easy case go sour becuase of a mis-q to the judge.
